PRIVACY POLICY (English)

Privacy policy pursuant to and for the purposes of art. 6, and art. 13-14 of the General Data Protection Regulation, Reg EU 2016/679 (hereinafter, “GDPR”), as well as art. 13 and 23 of the Italian Legislative Decree no. 196/2003 (hereinafter, “Privacy Code”)

The new EU Regulation for the protection of personal data No. 679/16 and Legislative Decree 196/03 have the purpose of guarantee that your personal data are processed in compliance with the rights of fundamental freedoms and the dignity of persons, with particular reference to the Privacy and personal identify. Therefore, it is our duty to inform you about our Privacy Policy. WTC S.r.l., with headquarter offices in Trieste, via San Nicolò 15, VAT No. 01267020327 (hereinafter “Data Controller” or “Owner”), as Owner, in the person if its legal representative, Mrs. Cristina Sbaizero, informs you, pursuant to and for the purposes of Articles 13-14 GDPR and of the Articles 13 and 23 of the Privacy Code, that your data will be processed in the below-mentioned manner and for the following purposes:

1. Object of processing

The Owner processes your personal data (i.e. name, surname, company name, address, telephone number, e-mail address, bank and payment information) – hereinafter “personal data” or even “data” – which you have communicated for the preparation and finalization of the contracts for the services offered, for the attendance to an organized event, or after filling the form available at the site www.wtctrieste.com to require information related to the services offered and/or after the Membership application to the World Trade Centers Association Network.

2. Purpose of processing

Your data are processed in the following way:

1. A) without your express consent (art. 6, paragraph 1 of the GDPR, and art. 24 of the Privacy Code) for the following purposes:

– to finalize the contracts for the services provided by the Owner;

– to fulfill the pre-contractual, contractual and fiscal obligations deriving from relations established with you;

– to fulfill the obligations established by law, by regulations, by community legislation or by an order of the Authority;

– to exercise the rights of the Owner, i.e. right of defence in Court;

1. B) only with your specific consent (art. 7 of the GDPR, article 23 of the Privacy Code), for the following marketing purposes:

– to send you via e-mail, postal service and/or SMS and/or phone contacts, newsletters, commercial communications and/or advertising material referred to products or services offered by the Owner, plus assessment questionnaires to collect information on the degree of satisfaction on the quality of the services offered;

– to send via e-mail, postal service and/or SMS and/or phone contacts, commercial and/or promotional communications of third parties (i.e. business partners).

WTC S.r.l. might also process data, defined “particulars” in the art. 9 of the GDPR, as suitable to reveal:

–  working relationships between the employer and third parties;

–  the state of health (absences due to illness, maternity, injury); neither genetic or biometric data are not processed;

– subscription to a labour union, subscription to a political party, or holding public elective offices (permits or leave), religious convictions.

We remark you that if you are already customer of WTC S.r.l., or “Member”, we are allowed to send you commercial communications related to the Owner’s services and products similar to what you have already received, except in case of your disagreement.

3. Processing procedure

Pursuant to the art. 5 of the GDPR, the processing of your data will be based on the principles of correctness and transparency; it could be also carried out through automated procedures finalized in storing, managing and transmitting them (through the operations highlighted in art. 4 No. 2 of the GDPR and in the art. 4 of the Privacy Code) and it will take place through appropriate tools to ensure its security and confidentiality by using appropriate procedures aimed at avoiding the risk of loss, unauthorized access, illicit use and unauthorized dissemination.

4. Data communication

Your data may be shared also with the other employees and collaborators of the Owner, as persons in charge and/or responsible for processing them; furthermore they might be also viewed by the external subject in charge of overseeing our informatic and informative system; your data might also be disclosed to companies and professional firms that provide – in outsourcing – assistance, consultancy or collaboration to the Data Processor in accounting, administrative, tax, legal, financial and commercial fields, as well as to Public Administrators for the performance of their institutional functions, within the limits fixed by the law or by the regulations, and to the service suppliers with whom is necessary sharing them to fulfill to the services included in the contract, if we were entrusted with an assignment for which it is requested their intervention.

Without needing an express consent ex art. 6, chapter 1 GDPR, as well as art. 24 of the Privacy Code, the Data Controller may communicate your data for the purpose referred to in the art. 2.A.) to Supervisory Bodies, Judicial Authorities, as well as to those subject to whom the communication is mandatory by law the accomplishment of the mentioned purposes.

Your data will not be disclosed in any other way.

5. Data storage

Your personal data will be kept for the time necessary for the fulfillment of the existing relationships between the parties, and in any case, they will not keep for more than 10 years from the end of the relationship as required by law.

After this period, the data will be destroyed and/or deleted.

6. Data transfer

The data can also be shared with the foreign office of other World Trade Centers belonging to the World Trade Centers Association World Network, both European and non-European. You may exercise your rights directly with respect to each Owner, accordingly to the respective applicable laws.

7. Type of data provision and consequences of the refusal to answer

The communication of your data for the purposes referred to in point 2.A) is mandatory. In their absence, we will not be able to guarantee you the requested Services.

The data provision for the purposes referred to in point 2.B) is optional. You can therefore decide to refuse to provide with any data or to subsequently deny the possibility of processing data already provided. In this case, you will not be able to receive newsletters, commercial communications and advertising material concerning the Services offered by the Owner.

However, you will continue to be entitled to the Services referred to in point 2.A).

8. Your rights and choices

You have the right to ask the Owner for the access to data concerning you, their correction or deletion, the integration of incomplete data, to limit their procession; to receive data in a structured format, commonly used and readable by automatic device; to revoke any consent given regarding the processing of your sensitive data at any time and object in whole or in part to the use of your data; to make a complaint to the Authority, as well as to exercise the other rights recognized to you pursuant to art. 15-22 EU Regulation n.679 / 16 and art. 7 Legislative Decree 196/03.

9. How to exercise your rights

The interested party has the right to make a complaint with the Control Authority.

If you should no longer be interested in receiving communications by WTC S.r.l. and if you want to cancel your subscription to the newsletter service, you can do it by clicking on the “cancellation” link at the bottom of each e-mail sent or by sending an e-mail to: info@wtctrieste.com.

10. Data Owner

The Owner of the data is the company WTC S.r.l., with head office in Trieste, Via San Nicolò 15, P.IVA e C.F. 01267020327, represented by the CEO, Mrs. Cristina Sbaizero; E-mail: info@wtctrieste.com.

The Owner uses internal and external data processors appointed to achieve the purposes specified in point 2 (technical purposes related to the provision of the service and commercial purposes).

The updated list of data processors and recipients of the data is kept at the head office.

11. Commercial activities

From the moment you enter your data by filling the application form available on the site www.wtctrieste.com, to apply for the Membership to the WTCs Network and for the services request, we may use your contact information to send you commercial communications and notifications about new services provided by WTC S.r.l., that we think may be aligned with your interest.

12. Update of Privacy Policy

This Privacy Policy may be changed. If relevant changes are made, changing the use of data of the user by WTC S.r.l., this will be notified by publishing this information in the website www.wtctrieste.com.

INFORMATIVA SUL TRATTAMENTO DEI DATI PERSONALI (Italian)

Informativa ai sensi e per gli effetti di cui all’art. 6, Regolamento UE n. 679/16, agli artt. 13-14, Reg UE 2016/679 (nel prosieguo, GDPR), nonché art. 13 e 23 D.Lgs. 196/2003 (nel prosieguo, Codice Privacy)

Il nuovo Regolamento UE per la protezione dei dati personali n. 679/16 e il D.Lgs. 196/03 hanno la finalità di garantire che il trattamento dei Suoi dati personali si svolga nel rispetto dei diritti delle libertà fondamentali e della dignità delle persone, con particolare riferimento alla riservatezza e all’identità personale. Pertanto è nostro dovere informarLa sulla nostra policy in materia di privacy.

WTC S.r.l., con sede legale in Trieste, via San Nicolò 15, P.IVA e C.F. 01267020327 (in seguito Titolare), in qualità di Titolare del trattamento, nella persona del proprio rappresentante legale dott.ssa Cristina Sbaizero, La informa, ai sensi e per gli effetti di cui agli artt. 13-14 GDPR e degli artt. 13 e 23 Codice Privacy che i Suoi dati saranno trattati con le modalità e per le finalità seguenti:

1. Oggetto del trattamento

Il Titolare tratta i dati personali, identificativi (ad esempio nome, cognome, ragione sociale, indirizzo, telefono, e-mail, riferimenti bancari e di pagamento) – in seguito “dati personali” o anche “dati” – da Lei comunicati in occasione della predisposizione e conclusione di contratti per i servizi offerti, della partecipazione agli eventi organizzati, a seguito della compilazione del form all’interno del sito www.wtctrieste.com per avanzare la richiesta di informazioni relative ai servizi offerti e/o in seguito all’adesione al Network della World Trade Centers Association.

2. Finalità del trattamento

I Suoi dati personali sono trattati:

1. A) senza il Suo consenso espresso (ex 6, c.1 GDPR, nonché art. 24 Codice Privacy) per le seguenti finalità di servizio:

– concludere i contratti per i servizi del Titolare;

– adempiere agli obblighi precontrattuali, contrattuali e fiscali derivanti da rapporti con Lei in essere;

– adempiere agli obblighi previsti dalla legge, da un regolamento, dalla normativa comunitaria o da un ordine dell’Autorità;

– esercitare i diritti del Titolare, ad esempio il diritto di difesa in giudizio;

1. B) solo previo Suo specifico e distinto consenso (ex 7 GDPR, nonché art. 23 Codice Privacy), per le seguenti finalità di marketing:

– inviarLe via e-mail, posta e/o sms e/o contatti telefonici, newsletter, comunicazioni commerciali e/o materiale pubblicitario su prodotti o servizi offerti dal Titolare e rilevazione del grado di soddisfazione sulla qualità dei servizi;

– inviarLe via e-mail, posta e/o sms e/o contatti telefonici comunicazioni commerciali e/o promozionali di soggetti terzi (ad esempio, business partners).

WTC S.r.l. potrà inoltre trattare dati che l’art. 9 del DGPR definisce “particolari” in quanto idonei a rivelare:

–  i rapporti di lavoro in essere con il datore e soggetti terzi;

–  lo stato di salute (assenze per malattia, maternità, infortunio); non vengono trattati dati genetici o biometrici;

–  l’adesione ad un sindacato, l’adesione ad un partito politico, o la titolarità di cariche pubbliche elettive (permessi o aspettativa), convinzioni religiose.

Le segnaliamo che se siete già nostri clienti, ovvero “Member”, potremo inviarLe comunicazioni commerciali relative a servizi e prodotti del Titolare analoghi a quelli di cui ha già usufruito, salvo Suo dissenso.

3. Modalità di trattamento

Ai sensi dell’art. 5 GDPR il trattamento dei Suoi Dati sarà improntato ai principi di correttezza, liceità e trasparenza e potrà essere effettuato anche attraverso modalità automatizzate atte a memorizzarli, gestirli e trasmetterli (per mezzo delle operazioni indicate all’art. 4 n. 2) GDPR e all’art. 4 Codice Privacy) ed avverrà mediante strumenti idonei a garantire la sicurezza e la riservatezza tramite l’utilizzo di idonee procedure che evitino il rischio di perdita, accesso non autorizzato, uso illecito e diffusione.

I Suoi dati personali sono sottoposti a trattamento sia cartaceo che digitale.

Il Titolare tratterà i dati personali per il tempo necessario per adempiere alle finalità di cui sopra e comunque per non oltre 10 anni dalla cessazione del rapporto per le finalità di servizio ed obblighi imposti dalla legge.

4. Comunicazione dei dati

Dei dati potranno venire a conoscenza gli altri lavoratori dipendenti e collaboratori del Titolare nella loro qualità di incaricati e/o responsabili del trattamento dei medesimi, nonché potranno essere visualizzati anche dal soggetto esterno che sovrintende il nostro sistema informatico; i Suoi dati potranno altresì essere comunicati alle società e studi professionali che prestano – in outsourcing – attività di assistenza, consulenza o collaborazione al Titolare del trattamento, in materia contabile, amministrativa, fiscale, legale, tributaria, finanziaria e commerciale, a pubbliche amministrazioni per lo svolgimento delle funzioni istituzionali nei limiti stabiliti dalla legge o dai regolamenti e a terzi fornitori di servizi cui la comunicazione sia necessaria per l’adempimento delle prestazioni oggetto del contratto, qualora venisse a noi affidato un incarico che richiedesse il loro intervento.

Senza la necessità di un espresso consenso ex art. 6, c.1 GDPR, nonché art. 24 Codice Privacy, il Titolare potrà comunicare i Suoi dati per le finalità di cui all’art. 2.A) a Organismi di vigilanza, Autorità giudiziarie, nonché a quei soggetti ai quali la comunicazione sia obbligatoria per legge per l’espletamento delle finalità dette.

I Suoi dati non saranno diffusi in altro modo.

5. Tempi di conservazione

I Suoi dati personali saranno conservati per il tempo necessario all’espletamento dei rapporti sussistenti tra le parti e comunque non per oltre 10 anni dalla cessazione del rapporto in essere di erogazione del servizio come da obbligo di legge.

Decorso tale periodo di conservazione, i Dati saranno distrutti e/o cancellati.

6. Trasferimento dati

I dati potranno inoltre essere comunicati alle sedi estere dei World Trade Center appartenenti al Network mondiale della World Trade Centers Association, sia UE che extra UE.

L’interessato può esercitare i propri diritti nei confronti di ciascun Titolare, in base alle rispettive legislazioni applicabili.

7. Natura del conferimento dei dati e conseguenze del rifiuto a rispondere

Il conferimento dei dati per le finalità di cui al punto 2.A) è obbligatorio. In loro assenza, non potremo garantirLe i Servizi richiesti.

Il conferimento dei dati per le finalità di cui al punto 2.B) è invece facoltativo. Può quindi decidere di non conferire alcun dato o di negare successivamente la possibilità di trattare dati già forniti: in tal caso, non potrà ricevere newsletter, comunicazioni commerciali e materiale pubblicitario inerenti ai Servizi offerti dal Titolare.

Continuerà comunque ad avere diritto ai Servizi di cui al punto 2.A).

8. Diritti dell’interessato

Lei ha diritto di chiedere al Titolare l’accesso ai dati che la riguardano, la loro rettifica o la cancellazione, l’integrazione dei dati incompleti, la limitazione del trattamento; di ricevere i dati in un formato strutturato, di uso comune e leggibile da dispositivo automatico; di revocare il consenso eventualmente prestato relativamente al trattamento dei Suoi dati sensibili in qualsiasi momento ed opporsi in tutto o in parte, all’utilizzo dei dati; di proporre reclamo all’Autorità, nonché di esercitare gli altri diritti a Lei riconosciuti ai sensi degli artt. 15-22 Regolamento UE n.679/16 e art. 7 D.Lgs. 196/03.

9. Modalità di esercizio dei diritti

L’interessato ha diritto a proporre reclamo presso un’Autorità di controllo.

Qualora non fosse più interessato alle comunicazioni della WTC S.r.l. e volesse cancellare la Sua iscrizione alla newsletter, potrà farlo cliccando sul link “cancellazione” presente in fondo a ciascuna e-mail inviata o inviando una e-mail all’indirizzo: info@wtctrieste.com.

10. Titolare del trattamento, responsabili ed incaricati

Il Titolare del trattamento è la WTC S.r.l., con sede legale a Trieste, in via San Nicolò 15, P.IVA e C.F. 01267020327, nella persona del proprio legale rappresentante dott.ssa Cristina Sbaizero; E-mail: info@wtctrieste.com.

Il Titolare del trattamento si avvale di incaricati del trattamento interni ed esterni nominati per il raggiungimento delle finalità specificate al punto 2 (finalità tecniche legate all’erogazione del servizio e finalità commerciali).

L’elenco aggiornato dei responsabili, degli incaricati al trattamento e dei destinatari dei dati è custodito presso la sede legale del Titolare del trattamento.

11. Comunicazioni commerciali

Dal momento in cui vengono immessi i propri dati compilando l’application form presente sul sito www.wtctrieste.com per la richiesta di adesione al Network e la richiesta di servizi potremmo utilizzare le Sue informazioni di contatto per inviarLe comunicazioni commerciali e notifiche relative a nuovi servizi offerti dalla WTC S.r.l. che riteniamo possano essere di Suo interesse.

Per disattivare la ricezione di e-mail promozionali, si prega di inviare una comunicazione all’indirizzo info@wtctrieste.com.

12. Modifiche

La presente informativa potrebbe essere soggetta a modifiche. Qualora vengano apportate sostanziali modifiche all’utilizzo dei dati relativi all’utente da parte di WTC S.r.l., questa avviserà l’utente pubblicandole con la massima evidenza sulle proprie pagine.
